The state of Montana needs our help in contacting their legislators to vote “NO”
on an Article V Amendments Convention, which leads to a Constitutional Convention (Con-Con).

 

Montana Needs You!

SJ5:   A joint resolution of the Senate and the House of Representatives of the State of Montana providing for the application for an Amendments Convention to the Constitution of the United States to be called for the purpose of proposing an amendment that provides that an increase in the Federal Debt requires approval from a majority of the legislatures of the separate States.

(Namely, a Con-Con.)

SJ5 is being sponsored by Art Wittich.  It was introduced on December 14, 2012 and referred to the Senate Judiciary Committee and read on January 7, 2013.  It was brought up for a hearing before the Senate Judiciary Committee on January 23, 2013.

There is no language provided in Article V to limit the power of a Constitutional Convention.  Article V states, “Congress…on the application of the Legislatures of two thirds of the several States, shall call a Convention for proposing Amendments…”.

According to Supreme Court Justice Warren Burger, “there is no effective way to limit or muzzle the actions of a Constitutional Convention.  The convention could make its own rules and set its own agenda.  Congress might try to limit the convention to one amendment or to one issue, but there is no way to assure that the convention would obey.  After a convention is convened, it will be too late to stop the convention if we don’t like its agenda.  The meeting in 1787 ignored the limit placed by the confederation Congress ‘for the sole and express purpose’.”

MESSAGE to Sponsor, Senator Wittich: Please table resolution SJ5.  Please don’t put our Constitution at risk by asking Congress to “call a Convention for the purpose of proposing amendments.”  Article V of the Constitution does not provide any way to limit an “amendments convention” or its power.  How can you expect the government to pay any attention to an amendment when they’re trampling on the whole Constitution right now?  Please don’t risk our Constitution.

MESSAGE to Chairman, Senator Murphy: Please do not bring resolution SJ5 up for a vote.
