Vote NO on Internet Sales Tax Bill SB 140

SB 140 will be up for a full Senate Vote on February 6, 2017 at 1:30 PM.  If passed, SB 140 would impose sales and use tax on most of YOUR internet purchases.  Legislators — this will affect YOU, too!  

VOTE NO on SB 140.

Currently, a Supreme Court decision, Quill v. North Dakota 504 U.S. 298 (1992)  requires that a seller have a physical presence, or “nexus” in the buyer’s state to become subject to the latter state’s sales tax. For example, if a resident of Arkansas buys something through the website of a Texas retailer, a sales tax obligation is only triggered if that Texas seller also has a store, warehouse, or other facility in Arkansas.

The Supreme Court conclusion was that it found the use tax to be unconstitutional because itinterfered with interstate commerce, rendering it a violation of the Commerce Clause. Consequently, the Court reversed the North Dakota Supreme Court's decision by ruling in favor of the Quill Corporation.

SB 140 TO PROVIDE FOR THE COLLECTION OF SALES AND USE TAX RATHER THAN USE TAX ON SALES BY CERTAIN REMOTE SELLERS.

Note: There is no need to generate more revenue for the state without first looking into the Comprehensive Annual Financial Report (CAFR) of Arkansas. Every government entity is keeping two sets of books.

The CAFR is the set of books that are hidden from the public.

  • One set of books is readily available to the public and shows how taxes must continually be increased to pay for increased demands upon government agencies to provide government services.
  • The other set of books details how governments pool tax revenues and, with the aid of modern investment strategies, are able to make millions, even billions of dollars in profits that are not made available to the public.

Things are not always the way they appear.  Check the Comprehensive Annual Financial Report (CAFR) of the City, County, School District, State, and Federal government to see where all the money is hidden. For starters, click here for the CAFR for the State of Arkansas for 2016.  Here is a good article on the CAFR:  "The Dumbing down of America Who Profits?” After reading this article and looking into the CAFR, you may change your beliefs on the need for additional State Revenues. Knowing about the CAFR really changed our beliefs.
