SB 140 will be up for a full Senate Vote on February 6, 2017 at 1:30 PM. If passed, SB 140 would impose sales and use tax on most of YOUR internet purchases. Legislators — this will affect YOU, too!
VOTE NO on SB 140.
Currently, a Supreme Court decision, Quill v. North Dakota 504 U.S. 298 (1992) requires that a seller have a physical presence, or “nexus” in the buyer’s state to become subject to the latter state’s sales tax. For example, if a resident of Arkansas buys something through the website of a Texas retailer, a sales tax obligation is only triggered if that Texas seller also has a store, warehouse, or other facility in Arkansas.
The Supreme Court conclusion was that it found the use tax to be unconstitutional because itinterfered with interstate commerce, rendering it a violation of the Commerce Clause. Consequently, the Court reversed the North Dakota Supreme Court's decision by ruling in favor of the Quill Corporation.
SB 140 TO PROVIDE FOR THE COLLECTION OF SALES AND USE TAX RATHER THAN USE TAX ON SALES BY CERTAIN REMOTE SELLERS.
