Repeal The Jonesboro Property Code!

Immediate Action Required: This is an urgent appeal from Secure Arkansas on behalf of the group Repeal Property Code 105-2. We are asking for you to contact this group to help gather the signatures needed to repeal the dangerous property code in Jonesboro, Arkansas! Unless 2,432 signatures are collected before February 10, 2016, the residents will be stuck with this tax travesty and strict enforcement, so a referendum is desperately needed. This needs to be placed on the ballot and voted on by Jonesboro residents.

This could be a personal invasion/inspection/intrusion on your home and 4th Amendment Rights if you do not heed this request! Everyone in that area better get motivated rather quickly. If you do not reside in that area, you can still go over there to help gather signatures. You could donate. Call them and help get the word out to others… At least sign the petition (and try to take someone with you) if you are a Jonesboro resident.  We’ve attached the Press Release below which includes bullet points of the invasive Jonesboro Property Maintenance Code.  We’ve included some additional information at the bottom of the alert as well.

Re: Group Plans Referendum of Jonesboro Property Maintenance Code

Because of the actions of the City Council and our Mayor, Jonesboro is now subject to one of the most invasive ordinances we have ever seen in Jonesboro. As a result, our group, Repeal Property Code 105-2, has formed in order to collect the 2,432 signatures of the residents of the city of Jonesboro, AR needed to force a special election to be held on May 3, 2016.  This is an extraordinary act that is being undertaken because our elected officials refused to listen to their constituents and voted this law into effect even as we were all celebrating the holidays. Our goal as a group is to educate each member of the public about the intrusion their elected officials want into their personal dwellings and make them aware of the potential fines they will face even for the most minor infractions.

The Jonesboro Property Maintenance Code:

  • Applies to "all existing residential and nonresidential structures," commercial and private property. (101.2)
  • Applies to interior and exterior (305.1)
  • Adds restrictions to you leasing, selling and even mortgaging your property. (107.6)
  • Sets unreasonable fines for even minor citations, "each day that a violation continues after due notice has been served shall be deemed a separate offense" and smallest fine can be up to $500.00 for first offense. (106.4)
  • Is all-inclusive: including such insignificant issues as cracks in concrete and the glaze on your windows. (101.2 & 305.1 & 301.1.1 & 304.13 & 304.13.1 & 304.3.1)
  • Worse yet: An unelected code official appointed by the Mayor is given authority to enforce and interpret the code and make all inspections. (103.2 & 102.8 & 103.1 & 104.1 & 104.2)
  • This same code official has "right of entry," the authority to enter your home to inspect it even without your permission." [A] 104.3
  • And this Code Official and his employees are "relieved from all personal liability for any damage accruing to persons or property" and gets free legal counsel if needed. (103.4)
  • Code offers no good recourse for owners unable to comply with code.  The code specifies only a burdensome appeal procedure that must be filed within 30 days with a Board appointed by the Mayor who also appoints the Code Official (who gives the citation.) [A] 111.1 & [A] 111.2

We did not start this fight, but our convictions related to each homeowner’s personal privacy rights are being violated. We believe this property code is in direct opposition to the 4th amendment of the United States Constitution, and as such, we must act.  We encourage all residents to sign a petition and help us place the Repeal on the ballot for May 3, 2016.

Also, a paragraph in the Jonesboro Sun article read,  "The West End Neighborhood Association plans to help fund assistance programs for homeowners who can't afford to bring their structures up to code through a private foundation and using federal grant funding."

As one of the leaders of this movement said,  “There is not enough money in Jonesboro to deal with the kind of violations enumerated in this code.”  And federal grant money is also our taxpayer money [it is not free money as West End seems to think]  and grant money would be just another form of redistribution of wealth and add to our $19 trillion national debt. We don't see how anyone could think that was a good move.

The Sun article included a phone number and email of Mark Pillow: "Pillow said anyone wishing to sign a petition can contact him at 926-3744 between 7 a.m. and 10 p.m. Monday through Saturday, or by email at censusguyz@gmail.com ."

Also, you can go to Home Health Professionals and Hospice Inc. at 2222 Spence in Jonesboro from 8:30 am to 5:00 pm and sign the petition or to pick up petitions that you can get signed. (Hospice is the 2nd building on the right on Spence, and Spence is just off Caraway; Spence is the next street after Magic Touch Cleaners on Caraway if you are heading South on Caraway.
