Now, shifting gears — the bad stuff!! We must keep an eye out for an offensive BAD bill HB1168 sponsored by Rep. Lee Johnson from Greenwood. It’s on the deferred list in the House Committee on Judiciary in Room 149 for Tuesday morning, Jan 28, but could come off that list anytime! Here is the agenda.

Arkansas appears to be Acting To Limit Legal Liability Of Healthcare Providers, Physicians and Healthcare Professionals For Care Provided During COVID-19 Pandemic. It also appears that it is the professional medical organizations that are advocating for such protections from the mandatory Covid-19 mandates of Dr. Anthony Fauci which Biden also pardoned just before he left office. (This makes Fauci really look guilty! How can you pardon someone who’s never been found guilty yet?)

HB1168  (This BAD bill will Make America UN-Healthy)

TO PROVIDE CRIMINAL IMMUNITY FOR HEALTHCARE PROFESSIONALS FOR NEGLIGENT ACTS OR OMISSIONS (Kill HB1168)

(b) A healthcare professional who is providing a healthcare service and is otherwise lawfully acting is immune from criminal liability for any harm or damages to the person receiving the healthcare service alleged to arise from a negligent act or omission related to providing the healthcare service.

Secure Arkansas has heard from many people who are OUTRAGED at this bill!

HB1168 would decriminalize medical mistakes made by health care providers. This is not good. HB1168 must be killed. If you have healthcare professionals making mistakes, they need to be run out of town.

From Harvard Law Today April 7, 2020 (It appears that this is one of the driving forces behind HB1168)

Some snippets:

Emergency statutes must be passed to protect doctors and hospitals from potential lawsuits, say Harvard Law professors  

State governments must enact emergency immunity statutes to protect doctors and hospitals from potential lawsuits and criminal prosecution during the COVID-19 pandemic, Harvard Law Professors I. Glenn Cohen ’03 and Andrew Manuel Crespo ’08 recently argued in The Journal of the American Medical Association. As they further explained in The New York Times, shortages of ventilators and other critical medical supplies will soon require physicians to ration precious resources, creating a risk of legal liability. With co-author Douglas B. White, a professor of critical care medicine at the University of Pittsburgh, Cohen and Crespo point to a Maryland law that grants immunity to health care providers acting in good faith as a model that other states should follow.
